SHIPPING LIABILITY AND CLAIMS

AutoGate shall not be liable for loss or damage of any material occurring after delivery by AutoGate to a carrier for shipment to OEM, Distributor, Dealer or its' customer and / or consumer. The receiving customer shall file all claims for damages or losses in transit directly against the carrier. AutoGate assumes no responsibility for damage to operator and gate since all shipments are Collect or Prepaid by the customer.

NOTE.- If gate or operator is received damaged, to ensure expediency in your claim, the receiving must:

      1. Note damage on Bill of Lading.
      2. Have driver sign Bill of Lading and retain copy for insurance.
      3. File damage report with carrier with a copy to AutoGate within 72 hours to prepare repair estimate for insurance.
      4. Refuse delivery and file damage report immediately.

The receiving customer agrees to make inspection of all products shipped upon arrival. Claims for shortages or defective materials must be made to AutoGate, in writing, within seven days after receipt of shipment. AutoGate may, at its' option, direct the OEM, Distributor, Dealer or its' customer and / or consumer to correct the condition in the field if it is defective material and reimburse them upon written approval by AutoGate as to the exact amount, or replace the material shipping via normal channels. If shortages in material should occur, it shall be AutoGate's option to reship via normal channels or to authorize them to take corrective measures in the field subject to an established amount as set forth by AutoGate in writing.
